Lockdowns were a morally and medically appropriate anti-contagion policy to stop the spread of Covid. However, lockdowns came with considerable costs. Specifically, lockdowns imposed harms and losses upon the young in order to benefit the elderly, who were at the highest risk of severe illness and death from Covid. This represented a shifting of the (epidemiological) burden of Covid for the elderly to a systemic burden of lockdown upon the young. This article argues that even if lockdowns were a morally (...) permissible response to Covid, the harms and losses they imposed on the young ground a claim of compensation. I defend an intergenerational compensation argument that defends a claim for an egalitarian intergenerational transfer to compensate the young for the harms of lockdown. (shrink)

Muhyiddin ibn Arabî, İslam'daki tartışmasız en etkili sufi teorisyendir. Arendt’s five criteria for evaluating the status of the Hungarian Revolution as a “true event” help shed light on the politics of Occupy Gezi (Arendt, “Totalitarian Imperialism” 5). In spite of the two movements’ similarly unprecedented, spontaneous, non-ideological, and un-hierarchical characters, the Gezi Park protests differed from the Hungarian Revolution in important ways. This is particularly true of the reaction of the protesters to the violence to which they were exposed. In refusing to react in kind to the state’s violence, the Gezi Park protesters created a new public domain for confronting the state. It is possible to consider this movement to have been an anti-violent rather than a non- or counter-violent resistance. Important political conclusions follow from this distinction. (shrink)

Examining Turkey’s Gezi Park protests of 2013 as a representative case of the globally surging protest movements since 2011, this study claims that the basic aim of the protests is to contest the foundational rationality of the modern state, which, I argue, is based on a patriarchal social contract that empowers the state with the authority to represent the interests and speak on behalf of citizens using a logic of protection, and to construct, enforce, and monitor a regime of (...) citizenship where citizens can only function as emasculated subjects who are dependent on the protection of the state. Based on an analysis of the use of gender metaphors and familial tropes by the AKP government, and the subversive use of humor and irony by the protestors, this article demonstrates that the protests target the patriarchal premises of modern statehood, both in its democratic (fraternal patriarchy) and authoritarian (paternalistic patriarchy) forms, and the state’s disciplinary, regulatory, and remedial interventions toward the interpellation of the citizen as an infantile or feminine subject who is not capable of meeting their needs and interests on their own, and whose life, therefore, needs to be continually monitored, controlled, and regulated by the state. Drawing on criticism brought to the contractual foundations of the modern state by feminist political theorists, this study makes use of the notion of modern patriarchy as a story told by social contract theories, which generates a power relationship between the state and the citizen based on the projection of threat where the state assumes the role of the protector. I conclude that objecting to these modern forms of subjugation, the Gezi Park protests call for a post-patriarchal state where it no longer resorts to a patriarchal protectionist logic that is justified through the claim that it represents the interests of its citizens. By envisioning such a post-patriarchal state, I interpret the protests as a call for the renegotiation of the foundational premises of modern statehood such that the state-citizenship relationship is radically reformulated to enable a more empowered and autonomous citizen. In this article, I argue for the distinctness of the 2013 Gezi uprisings from other anti-austerity protests. With a materialist feminist eye on the third-term AKP government's conservative authoritarianism, I explore the causal links among patriarchal, racist biopolitics, heteronormative family values and increasing austerity measures. My broader analytical goal is to demonstrate the centrality of moral politics to uneven, security-based neoliberal regulations across markets, public spaces, and civic expression in and beyond Turkey. Second, I zoom in on the mothers’ (...) rallies and gendered, ethnic acts of mourning to analyse the performative constitution of multiple publics during the protests. What exclusions have the participants produced in the name of inclusion? How can a performance paradigm help us understand the contradictory uses of space among and against the protestors, and more broadly, the relevance of embodied dissent to different visions of social justice? To deepen our intersectional feminist analysis, I suggest taking performances seriously, from human chains to soundscapes of resistance, stillness, and brutality; and from eclectic dance forms to architectural disruptions. Attending to the uprisings’ fault-lines and radical contributions, I also caution against ‘romancing resistance’. Hope with qualms is what remains. (shrink)

This article investigates a surplus quality that a “politics out of doors” embodies. It argues that forms of mass appearance and protest manifest an aesthetic and affective making of a people—a people that enjoys its togetherness through visualized, vocalized, and performative expressions of its presence. Generating and generated by a collective desire, this figure of a people exceeds “the people” understood as a legally authorizing and legitimating entity. I contend that the excess of desire can make popular protest a source (...) of “envy” for political authorities even at the height of their electoral power. In conversation with Melanie Klein and Joan Copjec’s accounts of “envy” and René Girard’s formulation of “mimetic desire,” I analyze the Turkish regime’s orchestration of the 2016 “Democracy Watches” as an attempt to create, harness, and appropriate a counter-equivalent desire to the 2013 antigovernment Gezi protests. In so doing, I reconceptualize peoplehood as the synergetic enjoyment of assembled collectivities. (shrink)

We motivate and introduce a new method of abduction, Matrix Abduction, and apply it to modelling the use of non-deductive inferences in the Talmud such as Analogy and the rule of Argumentum A Fortiori. Given a matrix $${\mathbb {A}}$$ with entries in {0, 1}, we allow for one or more blank squares in the matrix, say a i,j =?. The method allows us to decide whether to declare a i,j = 0 or a i,j = 1 or a i,j =? (...) undecided. This algorithmic method is then applied to modelling several legal and practical reasoning situations including the Talmudic rule of Kal-Vachomer. We add an Appendix showing that this new rule of Matrix Abduction, arising from the Talmud, can also be applied to the analysis of paradoxes in voting and judgement aggregation. In the verse (2:31) of the Qur’ān, it is mentioned that all names were taught to Adam (PBUH). This verse indicates that revelation is decisively the source of language. On the other hand, it is a common fact that people have been constantly producing symbols to express new ideas and concepts. This situation makes it necessary to associate the utterance (muṭlaq) and static with the relative (al-muqayyah) and dynamic between language and reality in religious thought. In the historical process, Mutakallims (...) have undertaken the responsibility of understanding and interpretation between the transcendent dimension of the religion (ad-Dīn) indicated in the Qur’ān and the innovative and dynamic dimension of life. The Mutakallims’ responsibility continues today. However, to establish the relationship among language, thought, and existence in today’s kalâm, it is necessary to identify the roots of this subject in kalām’s classical sources. In our study designed for this purpose, the truth and value of naming divine meanings in the context of ta‘līm al-asmā’ are examined. On the other hand, since dealing with such a large subject in a limited study is not possible, it is just focused on the research of linguistic theories, the relationship between language and thought, and the issue of whether the names used in the main sources to indicate the meanings are divinely determined (tawqīfī). In fact, it has been determined that the subject of ta'līm al-asmā’ is overshadowed by the vehement debates over the createdness of the Qur’ān (Khalq al-Qur’ān) and the relationship between Allāh’s essence and His attributes, although it is a Qur’ān-centered issue. As can be seen in the study, the approach of the Mutakallims to the issue of ta‘līm al-asmā’ is parallel to their understanding of Allāh’s essence and His attributes. As stated in this research, if the divine names were determined by Allāh, then Allāh’s names will be eternal. Besides, if the names expressed in human languages are the same as the essence of Allāh, this will lead to the problem of eternality. If it is said that the names are separated and unrelated from Allāh’s essence, there will be also more than one independent and eternal being. The idea of multiple eternal beings is against the principle of tawḥīd. However, in cases where the distinction between attributes and essence of Allāh is separated from each other in the mind, it causes attributes to be considered as something existing independently of the essence of Allāh. Therefore, as stated in the study, Mu‘tazilite theologians, who were very sensitive about this issue, attached great importance to the concept of eternity (qadīm) while transcending the essence of Allāh from the attributes of the created. As they appealed to tanzīh by which they transcend Him from all the originated things in time, they were focused on His eternality (qidam). In this regard, all His actions concerning the universe are regarded as temporal, in other words, originated in time (ḥādith). From this point of view, according to them, Allāh’s names specified in the Qur’ān are created just like the Qur’ān itself. Although their meanings are within the boundaries of the Divine Knowledge, their wordings (lafiẓ) belong to humans. Therefore, these names (asmâ’) that people use to describe Allāh in their speech, as Abū ‘Alī al-Jubbā’ī argues, are determined by the convention of the human. It has been determined by people via consensus, like other words of the language, to indicate the essence and attributes of Allāh in a language because of communication. Then, Allāh has sent down His message to people with these words. The conclusion that Mu‘tazilite theologians have regarded the connection of names with the meanings in Allāh’s knowledge as a linguistic use, while Sunnī theologians have addressed this issue based on the creative act (Khalq) of Allāh. There is another explanation which is known as the theory of faculty or habitus as an alternative way. Some Ash‘arî and Māturīdī theologians supported this theory. Today, the importance of this new perspective is clear, which appears another association of both ideas. In this context, it has been determined that the views of Māturīdī, who attributes the content (or meaning) of revelation (waḥy) to Allāh while arguing that its wordings belong to humans, are more appropriate to the theory of the faculty (malakah). Brill, 1988. Pp. 196. 74 guilders (approx. $37.00). This is a study of Aristotle's logic and psychology of mind which explores a connection between the two. This connection is used, on the one hand, to corroborate the results of the study of the logic and, on the other hand, (...) to elucidate the most controverted text of Aristotle's psychology, De Anima, 3. 5, with its discussion of active mind. Part 1 argues for the dependence of all discursive thinking on non-discursive sources of knowldge, viz., experience and intuition. Part 2, a bridge section, distinguishes logic, epistemology, and psychology: logic studies the forms of reasoning; epistemology studies the connection of reasoning to reality, as Aristotle does notably in Posterior Analytics, 2. 19; and psychology "shows how... cognitive processes... take place from the point of view of physics and First Philosophy " (p. 63). Part 3 investigates the psychology of cognition found in the De Anima and elsewhere and finds in it confirmation of the results of part l. In addition, Kal here offers a new interpretation of what Aristotle means by active mind. In part 1 Kal presents a careful textual study of Aristotle's view of definition, induction, and the syllogism, both dialectical and demonstra· tive, and argues that, as discursve methods, all of them presuppose knowledge already acquired, i.e., first principles that must be known. This raises the question of the origin of such principles, a question which Aristotle addresses and answers in Posterior Analytics, 2. 19. A common interpretation of this difficult chapter holds that first principles are grasped through induction. The text which seems to support this view is found in lines l00b3-5: " Thus it is clear that we necessarily know the first principles by induction; for sensation also produces the universal in this way." Kal argues that this text, when understood according to the indications of its context, does not make induction the source of first principles. Rather, Aristotle's position is that sensation, which gives us the universal, is based on experience (lOOall) and, therefore, an induction, which is also based on experience, also gives the universal (p. 51). Furthermore, Kal finds a much simpler argu· ment against the position that induction is the source of our knowledge of first principles in the beginning of Posterior Analytics, 2. 19, where "Aristotle rejects knowledge based on previous knowledge, and thus induction, as a solution to the problem of the knowledge of the first principles" (p. 52). Induction, then, remains one of the discursive methods, and, as such, depends on a kind of knowledge that is acquired 182 BOOK REVIEWS without being based on previously acquired knowledge. Kai insists that, if knowledge is possible, there must he a non-discursive origin for first principles; and, in his investigation of Aristotle's position, he finds only two such origins-experience and intuition. Sense experience brings the universal to light, although it does not know the universal as such, hut only as an accidental object of sensation. It is intellective intuition (nous) which knows the universal as such (p. 48). Having argued for the primacy of intuition (nous) in part l, Kai turns to the psychology of cognition in part 3. Is the primacy of nous corroborated by Aristotle's understanding of sensation and thinking? Kal finds that it is. From the point of view of logic and epistemology, the non-discursive origin of first principles is an immediate knowledge, a knowledge that does not require a middle term. As Kal puts it, the immediacy of intuition " lies... in the fact that contact is made with the object of knowledge simply, without active intervention of the knower" (p. 59). In receiving the object of knowledge the knower is completely receptive. Similarly, Kal argues, sensation and thinking in the sense of intuitive thought are also completely receptive, and this receptivity confirms the results of part l; cognition when viewed both from the point of view of logic-and epistemology, and from the point of view of psychology reveals the same essential receptivity. The problem of human freedom have been addressed by al-Mutakallimūn (Islamic theologians) in the context of human acts and discussed from the point of view its relation with the will and other elements. At this point, whether the human has will and power in his own act, the limits of his will and power, the role of human in the act and his responsibilities have prompted to different debates. The theory of tawlīd put forward by Mu‘tazila is very crucial in (...) terms of determining the scope and limits of the freedom of human in acts. Mu‘tazila’s tawlīd theory defenses based on two important reasons. The first is to present the nature and limits of the acts that man did them outside himself. The other is to explain the relationship of human with such acts with regards to moral responsibility. Because both issues are very important in the principle of justice of Mu‘tazila. The effort to put the cause-effect relationship of human with his acts in terms of tawhīd and justice on the rational and moral ground is the reason for emergence of the theory. In this respect, the purpose of this theory which enables establishing a causality relationship between the human act and nature is aimed at the justification of freedom and responsibility between agent (fā‘il) and act.In this study, firstly, the definition of the concept of tawlīd and its meaning area have been presented and tackled the discussions about the agent of indirect acts. And then it has been discoursed upon the criticisms of Ahl al-Sunna about the subject of tawlīd. The subject has been outlined in the context of the intellectual discussion between Ahl al-Sunna and Mu‘tazila which constitute the dominant part of theological dispute tradition. In this respect, the main purpose of the study is to reveal how the limits of indirect actions belonging to human by force of freedom and moral responsibility are drawn and understood.Although they did not have a uniform thought about the topic, Mu‘tazila theologians who accepted semi-determinism in the theory of tawlīd acknowledged the existence of natures in the substances. Those who admitted the reason as a means of the act did not approve this. By accepting the continuity of the accidents in the acts, they twisted together the voluntary acts and the natural acts, and accepted that directly acts were realized through the human will and the other according to the principle of necessity. According to Mu‘tazila, causes are only means. Hence, the act emerging as a result of the means is the act of the agent who used this means to reach the result, not the means. Therefore, man is the agent of engendered acts and responsible for all kinds of acts that arise as a reflection of the will and their consequences. While Ahl al-Sunna has directly associated the action of man and all its consequences with the power of Allah, Mu‘tazila has based these actions on the power of man, which Allah has created in man and has been the source of the acts. Contrary to Mu‘tazila, the continuance of power which are not a constant accident is not possible for a second act from the point of Ahl al-Sunna since they have accepted the idea that the accidents will not be continuous. In this respect, according to Ahl al-Sunna, there is no compulsory relationship between the agent that caused the formation of the acts and the result supervening from them. They did not accept the idea of tawlīd, which its meaning is that accident gives birth to accident, because it would oblige the relationship between cause and effect. Because this relationship, which Mu‘tazila gives the name of tawlīd in human acts, is made up for that Allah has created His laws right after the orientation of human to the cause. In this respect, Ahl al-Sunna thinkers rejected tawlīd because it would mean attributing an act to an inanimate being and require a mandatory relationship between cause and effect in the functioning of the universe. Although the result does not occur with his own act when the person applies to the cause, he is responsible for his act because it is related to the person who did it. Māturīdī tradition did not accept the acts that emerged as a result of tawlīd as the production of man, but they tried to establish a balance by holding the person responsible because he is the reason for the outcome that emerged. As for the Ash‘arites, they avoided giving a real effect of the will and power to the causes by considering that created will and power is only a locus in the emergence of the act. The person has no effect on his act except for directing his will to that act and his behavior which will make the person responsible is based on this will. (shrink)

The science of Kalâm, expressed as Uṣûlü'd-dîn in Islamic thought, is a constructional science. This means that the science of Kalâm has a dynamic structure in social life as well as a theoretical beginning. Kalâm has played an important role in the implementation of the idea of tawhid and the justice-based life that will accompany it by taking into account the historical and geographical heritage of Muslim communities on how to understand the hopes of religion. It is known that the (...) political and social events that took place in Muslim society also took place in the history of Islamic thought as a theological sect in the later historical process. Muslims, part of a geography that has historically been the source of ancient cultures and thoughts, tried to protect the basic hopes of the religion they belonged to while also responding to the accusations of members of different faiths against Islam. Like other Islamic sciences, the science of Kalâm was formed later as a discipline. Depending on the method followed in understanding religious thought, theological sects were formed. Two basic approaches are dominant in the historical process and the general practice of the Muslim society. There is a rational trend that tends to use ta'wil to understand the verse based on nass and those qualified as Ahl-i hadith that do not accept ta'wil except for narration. The supporters of this method will later be described as Mu'tazila. There are dozens of theological sects shaped around these two basic ideas. This historical use of kalâm is rife with contradictions. They take a serious attitude towards those who use the kalâm method of the Ahl-i hadith. Although this is the case, the science of Kalâm as a discipline has played a very fundamental role in the Muslim society from the very beginning to the present. Unfortunately, the constructive function of the Science of Kalâm historically has not been continuous. As in other Islamic sciences, the Science of Kalâm became after a certain time a form of repetition or interpretation of what was written in the past, with commentaries and annotations instead of original copyright works. This naturally caused the Muslim community to imitate the past in every aspect of life and thus not be able to build a future. Muslim scholars have tried to address this over time and across geographies. A part of this early effort was the necessity of reinterpreting Islamic sciences. In the modern period (19th-20th century), a search for innovation has been made in all Islamic sciences. The main purpose of these efforts was the re-evaluation of Islamic sciences in accordance with the conditions of the age. One of those who was a part of this important and meaningful struggle is Fazlur Rahman (d.1988). He criticizes the science of Kalâm as well as other Islamic sciences and make suggestions to make Kalâm gain a dynamic structure. While Fazlur Rahman's criticism of Kalâm is included, the early period criticism of Kalâm will also be briefly mentioned in order to provide a better understanding of the subject. A comparison will be made between the thoughts of those who criticized Kalâm in the early period and those of Fazlur Rahman in the modern period. While there is an opposition to Kalâm in the form of the rejection of the science of Kalâm as a discipline, especially in the thought of Ahl al-Hadith, the science of Kalâm was considered as a constructional science in Fazlur Rahman. In addition to arguing that the Science of Kalâm should be reorganized as a discipline in terms of the method and content, Fazlur Rahman emphasizes the necessity of considering the past as an experience that must be understood according to the conditions of the day. For Fazlur Rahman, one of the reasons made Muslim thought inert is because the discipline of Kalâm does not consider present social life. In the 20th century, with modernism, theological debates gained a new dimension, and developments in all areas of social life gave birth to a brand new culture very different from the past. Erken dönemlerden itibaren fıkhî meseleler üzerindeki tartışmalar, bir yönteme bağlı kalınarak icra edilmiştir. Tartışmalarda belirli soru ve cevap türlerine başvurulmuş, soruların tertibine özen gösterilmiştir. Bu sayede taraflar kendi görüşlerinin doğruluğunu, karşıt görüşün yanlışlığını çelişkiye düşmeden ortaya koymaya çalışmıştır. Bu çalışmada ilk olarak cedelden ve cedelin fıkha tatbikinden bahsedilmiş, sonrasında münâzaracı kimlikleriyle meşhur olan Hanefî fakihi Kudûrî ile Şâfiî fakihi Ebu’t-Tayyib et-Taberî arasında geçtiği rivayet edilen talâka dair bir münâzara inceleme konusu edilmiştir. Bu münâzarada, muhâlea ile boşanılan kadına, kadının iddeti esnasında (...) tekrardan ricî talâk yapılabileceğini savunan Kudûrî ile bu durumda talâkın geçersiz olacağını söyleyen Taberî’nin karşılıklı istidlal ve itirazları yer almaktadır. Bu tartışmanın temelini Kudûrî’nin muhâlea yapılan kadını ricî talâkla boşanan kadına kıyas etmesi oluşturmaktadır. Taberî bu kıyasın illetine yönelik mutâlebe, itirâz ve muâraza türü sorulara başvurmuş, Kudûrî ise kendi illetinin sıhhatini savunmaya çalışmıştır. Yer yer tartışma kurallarına atıfların yapılması yönüyle de önemli olan bu münâzara incelenirken, cedelin fıkha tatbikine dair kısımda zikredilen bilgilerin pratikte nasıl uygulandığına işaret edilmiştir. Bu makalede, râ harfinin tefhîm/kalın ve terkîk/ince okunmasına dair hususlar son dönem Osmanlı kurrâlarından Bursalı Süleyman Vehbi’nin (öl. 1334/1916) Risâle-i Râiyye adlı eseri ekseninde ele alınmıştır. Kur’ân harflerinin seslendiriliş biçimini ifade eden fonetik farklılıklar kıraat ilminin amelî/pratik boyutunu oluşturan en önemli unsurdur. Bu minvalde Kur’ân alfabesindeki harfler genel olarak, birbirinin zıddı olan tefhîm-terkîk sıfatlarından biriyle seslendirilmektedir. Bununla birlikte lâm ve râ harfleri bazen kalın bazen de ince okunmaktadır. Lâm harfinde aslolanın terkîkle telaffuz edilmesi olup bazı durumlarda tağlîzle/tefhîmle okunduğu hususunda ittifak (...) edilmiştir. Fakat âlimler râ harfinin tefhîm veya terkîki konusunda ihtilaf etmişlerdir. Bazıları, aslı itibariyle râ harfinde tefhîm-terkîk özelliği bulunmayıp birtakım şartlar muvacehesinde bunlardan birisiyle okunduğunu söylerken; cumhur ise râ’da aslolan tefhîm olup bazı şartlar çerçevesinde terkîkle okunduğunu ileri sürmüştür. Husûsen Verş (öl. 197/812) rivâyeti ve Ezrak (öl. 240/854) tarikine göre râ harfinin tefhîm-terkîkle okunması gereken yerlerin tespiti kıraat tedrisatında zaptı en zor olan hususlardan addedilmiştir. Hâl böyle iken günümüze değin râ harfine dair kurrâ arasındaki ihtilafların tam anlamıyla açıklanıp vuzuha kavuşturulduğu -Süleyman Vehbi’nin risâlesi dışında- Türkçe bir eser kaleme alınmamıştır. Türkçe eserlerde râ’nın okunuşuna dair hususlar genelde Hafs (öl. 180/796) rivâyeti özelinde işlenmiş, Verş ve Ezrak’ın, râ harfini okuyuş keyfiyetlerine yönelik bilgilere yeterli ölçüde yer verilmemiştir. Bu bağlamda mezkûr boşluğun doldurulması, çalışmanın amaçlarından biridir. Makalenin Risâle-i Râiyye çerçevesinde ele alınmasının sebebi müellifin, Osmanlı’daki kıraat tedrisinde temel kaynak olarak kullanılan en-Neşr, İthâf, Zübdetü’l-irfân, Umdetü’l-hullân, el-Îtilâf, Bedâi‘u’l-burhân ve Mürşidü’t-talebe gibi eserlerin hemen hepsine müracaat edip konuyu sistematik bir şekilde ele alması ve yeri geldikçe mezkûr eserlerdeki hata ve eksikliklere değinmesidir. Makalede öncelikle müellifin hayatına yer verilmiş, ardından risâlede işlenen konular tavzih edilmiştir. Bu yapılırken müellifin verdiği bilgilerin aslî kaynaklardaki yeri ve râ’nın tefhîm-terkîk ile okunmasının illeti/sebebi tespit edilmeye çalışılmıştır. Ayrıca müellifin eser içerisinde hata ve eksikliklerine değindiği kaynakların ilgili yerleri tespit edilip hangi ibare ve ifadelerle tashih edilmesi gerektiğine işaret edilerek araştırmacılara kolaylık sağlanması amaçlanmıştır. Çalışma sonunda görülmüştür ki Ezrak, esreli râlar’ın terkîkinde ve kelime başlarındaki fethalı-zammeli râlar’ın tefhîminde diğer kurrâ ile müttefiktir. Ancak kelime ortasında-sonunda bulunan mansûb-meftûh râlar’ı “kelimenin aslından olan lâzımî kesreli harften sonra gelmesi”, “lâzımî kesreyle râ’nın arasında sakin bir hurûf-i isti‘lânın -hâ/خ hariç- bulunmaması” ve “râ’nın sakin yâ harfinden sonra gelmesi” durumunda sadece terkîkle; bu şartları taşımakla birlikte râ’nın tenvinli olması durumunda terkîk ve tefhîm olmak üzere iki vecihle; bu şartlardan birinin bulunmaması durumunda ise sadece tefhîmle okumuştur. Mazmûm ve merfû râlar’ı ise mansûb râlar için zikri geçen şartları taşımaları halinde Verş sadece terkîk, Ezrak ise terkîk ve tefhîm vechiyle okumuştur. Burada şunu ifade etmek gerekir ki kütüphanelerde özellikle Osmanlı dönemine ait pek çok kıraat eseri gün yüzüne çıkarılmayı beklemektedir. Söz konusu eserlerin ortaya çıkarılıp incelenmesi hem süreç içerisinde kıraat ilminin nasıl bir seyir izlediğinin tespiti hem de mezkûr eserlerin verilerinden istifade edilerek yeni çalışmaların ortaya konulması açısından önem arz etmektedir. Câhiliye döneminde şair ve hatipler tarafından bir meleke olarak kullanılan belagat, geçirdiği hazırlık ve gelişim döneminin ardından ilmî teşekkülünü tamamlayarak Arap dil ilimlerinde müstakil bir dal haline gelmiştir. Ebû Ya‘kûb es-Sekkâkî (öl. 626/1229) öncülüğünde “meânî-beyân-bedî‘” olarak üç başlık altında ele alınmaya başlanan belagat konularının bedî‘ kısmına, Sekkâkî sonrası şerh ve hâşiye dönemi müellifleri tarafından yeni sanatlar eklenmiştir. Bu sanatlardan birisi de tarif ve tesmiyesi Sa‘duddîn et-Teftâzânî’ye (öl. 792/1390) ait olan tecâzüb sanatıdır. Farklı pek çok disiplinde ilmî ve edebî bir terim (...) olarak yer alan bu sanatın etkin kullanım alanlarından birisi de fıkıh ilmidir. Fıkıh sahasında bu sanattan istifade eden âlimlerden birisi Şemsuddîn Muhammed el-Kuhistânî’dir (öl. 962/1555). Kuhistânî Câmi‘u’r-rumûz adlı eserinde öşrün vücûbiyeti ve şart muhayyerliği konularını izah etmek üzere tecâzüb sanatına başvurmaktadır. Ne var ki Kuhistânî’nin kullandığı tecâzüb ifadesi ilim dünyasında anlaşılamayıp muğlak ifadeler olarak kalınca bu ifadelerden kastın ne olduğunu açıklayan bazı risâleler kaleme alınmıştır. Bunlardan birisi de ‘Abdulganî en-Nâblusî’nin çalışmamıza esas olan en-Nesîmu’r-rebî‘î fi’t-tecâzübi’l-bedî‘î adlı risâlesidir. Nâblusî’nin bu risâleyi kaleme almasının ana nedeni, kendisinden önce Kuhistânî’ye ait ifadeleri açıklamak gayesiyle Esne’l-metâlib fî beyâni ma‘ne’t-tecâzüb adında muhtasar bir risâle kaleme alan Seyyid Ahmed el-Hamevî’ye (öl. 1098/1687) reddiye yapmaktır. Nâblusî, Hamevî’ye ait bu risâleyi görmüş ve onun tespitlerinden bazılarını hatalı bulduğunu belirterek reddiye mahiyetinde mezkûr risâlesini kaleme almıştır. Hamevî’nin açıklamalarına ciddi eleştiriler getiren Nâblusî, öşrün vücûbiyeti ve şart muhayyerliği hususlarındaki Kuhistânî’ye ait ifadeleri tecâzüb sanatı açısından yeniden açıklama yoluna gitmiş ve bu konularda Hamevî’ye ait toplamda altı görüşe deliller getirmek suretiyle reddiye yapmıştır. Nâblusî’nin bu risâlesi; zengin kaynak kullanımı, yalın ifade üslûbu ve açıklayıcı örneklerle öne çıkmakta, tecâzüb sanatına dair kapsamlı bilgiler ihtiva etmektedir. Bu araştırma ile ilk olarak tecâzüb kavramı Teftâzânî üzerinden açıklanmış; ardından Nâblusî’nin mezkûr risâlesi, reddiye yaptığı Hamevî’ye ait risâleyle mukabele edilmek suretiyle detaylı olarak analiz edilmiştir. Bu noktada ilk olarak tartışmaya esas olan Kuhistânî’ye ait ifade verilmiş, ardından Hamevî’nin konuya dair açıklaması zikredilmiş, son olarak da Nâblusî’nin reddiyesine yer verilmiştir. Kitaplar, bir fikrin ve düşüncenin veya zihniyetin taşıyıcıları olduğu kadar, üretildikleri bağlama dair de bilgiler sunan kalıntılardır. Bir eserin yazma versiyonları söz konusu olduğunda, her bir nüshanın ayrı bir özgünlük değeri bulunmaktadır. Yazıma konu olan metin belki ortaktır ama yazma nüshalar; çoğaltan kişi, çoğaltılan yer ve zaman, çoğaltmada kullanılan yazı şekli, kâğıt türü gibi unsurlar bakımından kendilerine özgü nitelikler taşımaktadır. Eserin yazıldığı bağlam hakkında ilk elden bilgilerin sunulduğu bu kısımlara yansıyan içerik, bazen eserin tüm muhtevasından bile daha önemli olabilmektedir. Bu (...) yüzden de bazen her biri ayrı bir tarih vesikasına dönüşebilmektedir. ʿAlī b. Ötemiş b. Süleymān isimli fakat ʿAlā-i Aḫlāṭī olarak maruf bir Hanefî âlim tarafından istinsah edilen mecmūʿa bu bakımdan oldukça dikkat çekicidir. Mecmūʿa içerisinde Hanefî geleneğe dair çeşitli eserler yer almaktadır; ancak bunlardan daha önemli olan bu eserlerin nasıl ve nerede istinsah edildiğine dair müstensihin ferağ kayıtlarında verdiği bilgilerdir. Bu bilgilere bakıldığında, müstensihin muhtemelen Buhara kökenli olduğu ve Anadolu’ya gelip Ahlat’ı vatan edindiği görülmektedir. Artık Anadolu’da yaşamasına karşın, bir sebeple büyük Moğol istilasına maruz kalmasından on bir yıl önce Buhara’ya tekrar gitmiş, buradaki ilim meclislerinde bulunmuş ve önemsediği bazı eserleri istinsah edip yanında Ahlat’a getirmiştir. Bu mecmūʿa ise zamanla Kastamonu’ya kadar gelmiştir. Bu yazıda, söz konusu mecmūʿa nın ferağ kayıtlarında geçen bilgilerden hareketle ʿAlā-i Aḫlāṭī’nin hayat hikayesi ortaya çıkarılmaya çalışılmıştır. (shrink)

For little did anybody know that in the summer of 2013 İstanbul would become the stage of one of the most intriguing of urban uprisings in Turkish, if not world, contemporary history. In this article, I offer a politico-philosophical perspective to reassess the much-contested role of truth in politics to put forth a principle of political action that will make sense of a “right to unmanipulated factual information,” which Hannah Arendt understands as crucial for establishing freedom of opinion. In developing a principle of epistemic responsibility, I will show that “factual truth” plays a key role in Arendt’s account of political action and provides a normative order that can extricate her account from (...) charges of immoralism. The article will be divided into three sections: section 1 deals with the distinction between rational truths and factual truths, and the question of their validity, section 2 deals with what a principle of political action is, and lastly, section 3 proposes a principle of “epistemic responsibility” that becomes action-guiding in the political sphere, in order to shed new light on the 2013 Gezi Park protest, one of the recent democratic uprisings of our century. Bu çalışma hicrî birinci asrın ikinci yarısında Basra’da hadis ve fıkıh sahasındaki ilmî hareketliliği konu edinir. İlgili dönemde, orada yaşayan sahâbenin en meşhuru ve Hz. Peygamber’le en uzun süre birlikteliğe sahip olması hasebiyle, Enes b. Mâlik’in Basra’daki etkisi özel olarak ele alınır. Bu amaçla Enes b. Mâlik’le ilgili birçok rivayet tahlil edilir ve onun hem Basra’da hem de diğer şehirlerde yaşayan sahâbe ve tâbiûnla arasındaki ilmî ilişkileri üzerinde durulur. Çalışma mezkûr zaman diliminde Basra’da hadis faaliyetlerinin fazla, fıkıh faaliyetlerinin ise az (...) olduğunun tezahürlerini gösterir. Enes’in öğrencileri üzerindeki etkisi; öğrencilerinin fakih mi yoksa muhaddis mi olduğu araştırılır. Enes’in tabiûnla ilişkileri, kendisine yapılan rihleler, başka şehirlerde yaşayan fakih tabiûnun ondan rivayeti, İbn Ebî Şeybe’nin Musannef’i çerçevesinde onun fıkhî şahsiyeti ve başka meseleler incelenir. Böylece onun fıkhî melekesinin İbn Abbas ve İbn Ömer’le aynı derecede olmadığı ve benzer şekilde Basra’nın sahabenin fakihlerinden tabiûnun fakihlerine nakledilen “amel-i mütevâres”e önem veren Medine ve Kufe gibi bir fıkıh şehri olmadığı sonucuna ulaşılır. Basra, müksirûndan olan sahabî Enes b. Malik sayesinde hadislerin rivayetine, yayılmasına ve onlarla amel edilmesine önem verilen bir şehirdi. Ancak bu hadislerin yayılması aynı dönemde Mekke’de İbn Abbas’ın faaliyetleri ile kıyaslanabilecek bir fıkhî faaliyeti de beraberinde getirmedi. Dolayısıyla Basra sahabe döneminde fıkıh ilmî açısından geri kalırken hadis sahasında hareketliydi. Bu nedenle ona fıkıh ve “amel-i mütevâres” değil rivayet şehri denilmesini hak etmektedir. Bu makale Blaise Pascal’i bir iktidar düşünürü olarak incelemeyi amaçlamaktadır. Pascal’in, Descartes’tan farklı olarak akıl düzeni dışında iradenin yani yüreğin düzeni ve tenin yani dünyevi isteklerin düzenini ayırt etmesi, düşüncesinin temel bir özelliği olarak öne çıkmaktadır. Böylelikle düzenler arasında farklı güç odakları ve farklı rasyonalite tipleri gözeten Blaise Pascal için Kartezyen akıl iki açıdan rasyonel olarak işlemez. Birincisi gücün düzeninde fikirler yetersiz kalır. İkincisi ise imgelem akla rakip olmanın ötesinde aklın üzerine yaslandığı zeminin kurucusudur. Aklın sınırını çizen Pascal, hem aklı (...) daha etkin kullanmanın bir yolunu bulmuştur hem de aklın hiç işlemediği alanlarda akılla kavrayış geliştirmenin yarattığı sorunları göstermiştir. Bu bağlamda etkiler alanı aklın nedenleriyle anlaşılamaz aksine etkiler alanı kendisine ait bir akıl üretir. Güç hâkim olur, imgelemi kurar ve dünyevi istekleri yönetir. Bir fikir ile bir çıkar arasındaki mücadelenin galibi her zaman için güç sahibi olan çıkardır. Ancak bir güç, meşruiyet ilişkisi üretmeden iktidar olamaz. Bu yüzden her iktidar kendi duygularını, inanç ve fikir tiplerini de üretir. Pascal açısından gerçek bir hakkı ancak kılıç verir. Bu yüzden kılıçla hakkını elde eden iktidar kendisini adalet olarak sunar. Pascal’in düşüncesi iktidarı düşünmek açısından iki önemli yönelim sunmaktadır: İlk olarak iktidar akıl karşısında bir irrasyonalite değildir aksine kendisine ait bir rasyonalite sunar. MARMURA I MEDIEVALISLA_MICtheologians subjected Aristotle's theory of the essential efficient cause to severe criticism and rejected it. This criticism and rejection finds its most forceful expression in the writings of Ghazali (al-Ghaz~li) (d. 1111).1 In his Tahafut al-Falasifa (The Incoherence of the Philosophers), he argues on logical and empirical grounds that the alleged necessary connection between what is habitually regarded as the natural (...) efficient cause and its effect cannot be proven. He does not, however, take an agnostic stand on this question but proceeds to affirm two points: (1) that there is no causal agency in natural things; (2) that all natural events are the direct creation of God. Ghazali, moreover, does not confine such divine action to the realm of the inanimate and the irrational, in his al-Iqtis.~d fi-l-Ftiqad (The Golden Mean of Belief), he affirms the doctrine that the individual human act, like any other occurrence in the world, is also the direct creation of God. Causal efficacy resides in God alone. But the divine act, for Ghazali, is not an essential act. It does not proceed as the necessary consequence of divine essence. It is the arbitrary decree of the divine will, an attribute coeternal, but not identical with divine essence. Ghazali thus denies essential action altogether. In all this, he gives expression to the occasionalism of the Islamic school of dogmatic theology (kal~m) to which he belonged, the Ashcarite school. Ghazali had also a keen interest in logic. He wrote logical treatises for his fellow theologians, encouraging them to master this art as a tool to rebutt their doctrinal opponents. The~ treatises, in the main, sum up and explain the logic used by the Islamic philosophers--a logic that reflects the Stoic and Aristotelian traditions. Ghazali recognizes formal logic to be philosophically neutral, and hence in no way conflicting with his theology." And it is in his statements on demonstration that we seem to be confronted with paradox. Bu eserler, dinî-tasavvufi türlerden ayrılarak şefaatnâme olarak adlandırılmıştır. Şefaatnâmelerin geneli, eski Anadolu Türkçesi döneminde telif edilen Hikâye-i (...) Kesikbaş, Hikâye-i Deve, Hikâye-i Güvercin, Hikâye-i Geyik, Hikâye-i Kız, Hikâye-i İsa, Hikâye-i İsmail ve Hikâye-i İbrahim gibi dinî manzum hikâyelere anlatım ve üslup özellikleri bakımından benzemektedir. İslam dinini halka öğretmek amacıyla sade bir Türkçe ile kaleme alınan ve tahkiyenin ön planda olduğu bu hikâyelerden biri, muhtevasından dolayı şefaatnâme türü içerisinde değerlendirdiğimiz Şefaatnâme-i Yahyâ’dır. Çalışmamıza konu edilen bu eser, Süleymaniye Kütüphanesi Yazma Bağışlar Bölümü’nde 4042 demirbaş numarasıyla kayıtlı olan ve içerisinde Süleyman Çelebi’nin (ö. 1422?) Vesîletü’n-Necât’ı ile eski Anadolu Türkçesi döneminde telif edilen dinî muhtevalı pek çok manzum hikâyenin bulunduğu yazmanın 155a-160a sayfaları arasında yer almaktadır. Şefaatnâme-i Yahyâ, aruzun “fâ‘ilâtün / fâ‘ilâtün/ fâ‘ilün” kalıbıyla ve mesnevi nazım şeklinde yazılmıştır. 154 beyitten müteşekkil bu eserde, Hz. Muhammed’in günahkâr ümmet için üzülüp ağlaması, o esnada sohbetinde bulunan Hz. Ebû Bekir, Hz. Ömer, Hz. Osman, Hz. Ali, Hz. Ayşe ve Hz. Fatma’ya günahkâr kullara şefaat için ne yapacaklarını sorması ve onların da bu soruyu cevaplamaları tahkiye edilmiştir. Bu makalede, öncelikle şefaatnâme hakkında bilgi verilmiştir. Ardından, Şefaatnâme-i Yahyâ’nın dil, şekil, anlatım ve muhteva özellikleri incelenmiştir. Sonrasında ise Yahyâ’nın Şefaatnâme’sinde ele alınan konunun Ömeroğlu’nun (ö. 14. yy) Şefaatnâme’sinde, Pir Muhammed’in (ö.?) Şefaatnâme’sinde, Topkapı Sarayı Müzesi Kütüphanesi Y. Y. 520/2 numarada kayıtlı yazmanın 30a-34a yaprakları arasında bulunan müellifi meçhul bir şefaatnâmede de yer alması sebebiyle bu dört metin mukayese edilmiştir. Farklı şairlerin kaleminde, aynı olay örgüsünün nasıl ifade edildiği bir tablo dâhilinde ortaya konmaya çalışılmıştır. Makalenin sonunda, Şefaatnâme-i Yahyâ’nın transkripsiyonlu metni hazırlanarak araştırmacıların istifadesine sunulmuştur. (shrink)

The security bill that was proposed by the Justice and Development Party (AKP) government in 2014 has sparked controversy both within and outside the Parliament of Turkey. Yet, with AKP’s majority, the bill – which includes an anti-masking regulation for protests – was passed in spring 2015. In this article, first I demonstrate a partial mapping of the rhetoric employed by mainstream politics in Turkey, to underline that any oppositional political activity on the streets has the potential to be labeled (...) a ‘terrorist’ one – and most have been. Then, by taking one of the most prominent examples of these events, the Gezi uprising, I discuss the affirmative biopolitical potentialities of the uses of masks that the law criminalizes. Lastly, I situate the law globally in relation to the protest movements, on the one hand, and anti-masking laws on the other. (shrink)

From Cairo to Occupy Wall Street, from Istanbul Gezi Park to DANS protests in Sofia, in recent public sphere movements we have witnessed the emergence of a new wave of creative protest. The surge of creative forms of political action brings to the fore the question of democratic potential of creative political protest. This paper explores in what ways creative protest could deepen democracy. I argue that creative political protest nurtures democracy by generating a peaceful culture of resistance and (...) by providing a peaceful way of responding to politics of intolerance and polarization. Political protests involving clashes with police are often delegitimized by governments for using “uncivil” and “violent” means. Drawing on a creative video clip made by a group of Gezi protestors, this paper theorizes an alternative response, which refuses the dichotomy between peaceful and violent struggles and instead seeks to transform the field of judgement. The protestors in the clip, by echoing a verse originally written by poet Cemal Süreya, reconstruct destructive activity – breaking billboards – playfully and detached from (...) its presumed ends. Placing their performances in conversation with Giorgio Agamben’s theory of mediality – means without end – I argue that the clip reconstructs political action in play-form, corroding the significance of the means-ends relationship. In doing so, it frustrates the usual grounds of judgement within which the meaning and value of protest activities are arbitrated. (shrink)

Tanrı tasavvuru, İslam düşünce tarihinin en temel problemlerinden biri kabul edilmektedir. Tanrı’nın aşkın varlığı, O’nun standart kalıplarla tanımlanmasını olanaksız kılmaktadır. İlahi olanla beşeri olanın iletişimi ve etkileşimi, yapısal farklılık bakımından bir takım sorunları da beraberinde getirmektedir. Bu sorunlardan biri de insan biçimci Tanrı tasarımıdır. Bu tasarım, dinlerin ve felsefenin çözümlemesi gereken önemli bir mesele olarak önümüzde durmaktadır. Biz de Orta Çağ’ın önde gelen dinler ve felsefe tarihçisi, aynı zamanda da kelâm bilgini Şehristânî’nin bu meseleyi nasıl aktardığını, analiz ettiğini ve meselenin (...) çözümüne ilişkin hangi önerilerde bulunduğunu araştırdık. Bu çalışma sayesinde kurumsal anlamda mensupları ve eserleri neredeyse yok olmuş ekollerin görüş ve yöntemleri güvenilir bir şekilde ortaya konularak düşünce tarihi bir boyutuyla aydınlanmış olacaktır. Şehristânî, ne Tanrı’nın mahlûkata ne de mahlûkatın Tanrı’ya benzeyebileceğini savunmaktadır. Dolayısıyla ona göre Tanrı; cevher, cisim, araz, uzay-zamana bağımlı, arazları kabule elverişli ve yaratıklara mahal olamaz. O, Gulât-ı Şîa’nın Tanrı konusunda iki tür teşbih/benzetme yaptığını aktarmaktadır: Birincisi, yaratanı yaratılana; ikincisi ise yaratılanı yaratana benzetmektir. Bu ifade, ne Tanrı’da yaratılış emaresi ne de mahlûkatta ulûhiyet vasfı bulunabileceğine dikkat çekmektedir. O’na göre Gulât-ı Şîa, bu görüşlerinde gayr-i İslami inanç ve ideolojilerin etkisinde kalmıştır. Şehristânî, kimi Kerrâmiyye mensuplarını da Tanrı’yı cevher ve cisim olarak nitelendirmekle itham etmektedir. İslâm düşüncesinin henüz erken dönemlerinde terminolojik bir ittifakın oluşmaması ilerleyen dönemlerde böylesi tartışmalara kapı aralamıştır. Ayrıca Şehristânî, onların Tanrı’nın zâtını hâdis şeylere mahal olarak konumlandırdığını da iddia etmektedir. Oysaki Kerrâmiyye, Tanrı’nın zâtında sonradan ortaya çıkan şeyler/havâdis ile ezeli sıfatlar arasında bir ayrım yapmakta ve sonradan ortaya çıkan şeyleri “ilahi sıfat” olarak değil, hâlikiyyet, mürîdiyyet ve mütekellimiyyet gibi kavramlarla nitelendirmiştir. Nihayetinde Şehristânî, Kerrâmiyye’nin söylemlerini tevil kabul etmeyecek katı antropomorfik ifadeler olarak nitelendirmektedir. (shrink)

Makalede İlâhî vahyin insanın ontolojik gerçekliğini göz ardı etmediğini, ontolojik gerçekliği üzerinden insanlara mesaj verdiği konusu ele alınmıştır. Bu durum, rüya ve şeriatlerin farklılığıyla ispat edilmeye, bu fikre temayül gösteren ancak Kur’ân hakkında olumsuz bir argüman olarak kullanan Montgomery Watt gibi müsteşriklere de cevap verilmeye çalışılmıştır. Bu yapılırken ilk önce bilinçaltının anlaşılması hususunda bazı örnekler verilmiş sonra rüya sembollerinde baskın olan kültürel unsurlara temas edilmiştir. Rüyalardaki sembollerin şekillenmesinde mantıksal bağı irdeleyen İslam ulemasının açıklamalarına ve rüya tevillerine de yer verilmiştir. Bu (...) yorum ve tevillerden anlaşıldığı kadarıyla insanlarda ortak görülen sembollerin Jung’un arketip, İslam ulemasının ise zihinsel kalıp ve manaların elbisesi dediği bir nevi kültürün kodlarından oluşan bilinçaltı alfabesi tarafından formlaştığı anlaşılmaktadır. Dini değer ve ifadeler Müslüman kültürde en dominant öğeler olduğundan Müslüman yorumcular genelde rüya sembollerini Kur’an ve hadisteki sözler veya bu sembolleri çağrıştıran ifadelerle yorumlamaya çalışmışlardır. Bu mantıktan hareketle tefsirde büyük problem olarak görülen Hz. İbrahim’in, oğlu İsmail’i kurban etme olayı ele alınmış ve nasıl anlaşılmasının gerektiği üzerinde durulmuştur. Bunun, baskın kültür altında sembolleşen bir rüya olduğu ve İsrail Oğullarına ‘Bakar’ kesme emriyle toplumun yanlış algısının değiştirilmesinin amaçlanması gibi çocukların tanrılara kurban edildiği ortamdaki yanlışlığın giderilmesi, kurban ritüelini tebdil edilmesinin amaçlandığı ifade edilmiştir. Daha sonra şeriat-ontolojik gerçeklik ilişkisi irdelenmiş, dinde bütün insanların ortak fıtratının esas alındığı ve bundan dolayı dinin bütün insanlar için değişmeyen bir olgu, şeriatlerin ise kültürün baskın olduğu ve dolayısıyla bir yönüyle ilişki içinde olduğu toplumsal bilinçaltı olduğu vurgulanmıştır. Kur’ân’da, dinin temel prensipleri ve resullerin üzerine birleştikleri kapsamlı şeriat kanunları dile getirilmiştir. Genel hatlarıyla din, Allah’ın varlıkları üzerine yarattığı (insanın tabiatının kolektif değişmezliğine dayalı) ve bütün mahlûkata sevimli geleni, marufu emretmeyi, münkerden nehyi, temiz şeyleri helal eden, zararlı olan şeyleri haramı eden emirleri içermektedir. İslam ulemasına göre bütün semavi dinlerde esas olan Allah’a, meleklerine, resullerine, kitaplarına ve ahiret gününe iman etmek, insanın yaptığı takdirde Müslüman olacağı fiilleri işlemektir. Bu iman da doğal olarak dünyadan yüz çevirmeyi, ahirete yönelmeyi, güzel ahlakı edinmeyi ve kötü ahlaktan da kaçınmayı gerektirir. Ancak şeriatlar ise birbirinden farklılık gösterebilir. Çünkü şeriatlar dinin indiği toplumun hallerini ve maslahatlarını esas aldığından değişiklik arz eder. Şeriatların farklılaşmasında toplumsal bilinçaltının göz ardı edilmediğini göstermek bağlamında Kur’ân’dan örnekler verilmek suretiyle savunulan tez ispat edilmeye çalışılmıştır. Bunlardan birisi, Kur’ân’da Arapların ortak duygularının esas alınması, kültürel bazı unsurların kullanılması, bir diğeri de yabancı isimlerin Arapların ifade ettiği şekliyle, ümmi anlayışa uygun kullanılmasıdır. Ayrıca bu konuda bazı helal yiyeceklerin Yahudilere haram kılınması ve diğer şeriatlerde yer alan bazı farklılıklar üzerinde durulmuştur. Helal yiyeceklerin haram kılınması konusunda Hz. Yakub’un yakalandığı ağır hastalıktan iyileştiği takdirde sevdiği yiyecekleri yememeyi nezretmesi, buna bağlı olarak iyileşince deve eti ve sütünü yiyip içmemesi, daha sonra çocukları ve ümmetinin de bu yiyeceklerden uzak durması sonucunda Tevrat’ta bunların haram kılınması örneği üzerinde durulmuştur. Bu örnek, şeriatlerin farklılaşmasının nedeninin bir şeye karşı tavrın toplumsal bir alışkanlık halini almasının sonucu olduğu ifade edilmiştir. Nitekim teravih namazının Müslümanlarca toplu kılınması ve buna devam edilmesi durumunda farz kılınır endişesiyle evlerinde kılmalarını tavsiye eden Allah Resulünün endişesinin de bunu pekiştirdiği dile getirilmiştir. Diğer şeriatlerde bazı farklılıklar konusunda ise orucun öncekilere farz kılınmasına rağmen keyfiyetinin farklı olması üzerinde durulmuştur. Aynı şekilde namaz, zekât ve haccın semavî dinlerinin hepsinde olmasına rağmen keyfiyetinin değiştiği örneklerle izah edilmiştir. Bu doğrultuda milletlerin yaşam tarzlarının ve kültürünün dolayısıyla toplumsal bilinçaltı şeriatlerin farklılığında gözönüne alındığı ifade edilmiştir. Nitekim İsâ peygambere tabi olanların kendilerine emredilmemekle birlikte Allah’ın rızasını elde etmek için ruhbanlığı kendilerine farz kılmaları ve buna devam etmeleri karşısında Allah’ın buna itibar ederek, ruhbanlıkta bulunanlara ücretlerini verdiğini ifade etmesi de bu durumu pekiştirmektedir. Sonuç olarak din ve dine taalluk eden her şeyin insanlığın ortak fıtratını esas aldığını, şeriatten şeriate değişiklik gösteren unsurların da kültürel ve bir yönüyle toplumsal bilinçaltıyla ilgili olan hususlar olduğu ortaya konulmaya çalışılmıştır. Beylikler devri Türk-İslam ciltleri hem tezyînatları hem de üzerlerindeki dini içerikli ibareler, dua ve mücellid mühürleri vasıtasıyla cilt sanatı araştırmacılarının yayınlarına konu olmuştur. Ancak ciltlerdeki dua ifadelerini müstakil olarak konu edinen yayın sayısı oldukça azdır. Türk-İslam ciltlerinin gerek kapak yüzeyinde gerekse kapak içlerinde dua içerikli ibarelere rastlamak mümkündür. Makalenin konusu, Beylikler devrinde üretilen Türk-İslam ciltlerinin deri kaplı kapak içlerinde yer alan el-İzzü’d-Dâim ve’l-İkbâl (العزّ الدّائم والإقبال) yazısı, bu yazının yer aldığı desen kompozisyonu ve yazının analizidir. Makaledeki amaç, şimdiye kadar cilt (...) literatüründe müstakil olarak ele alınmamış el-İzzü’d-Dâim ve’l-İkbâl yazılı cilt kapak içi tezyînatı hakkında tespit edilebilen örneklerin detaylı desen ve yazı analizleriyle bilimsel birikim oluşturabilmek ve aynı ya da benzer ibarenin yer aldığı diğer İslam sanat eserlerini tespit ederek bu dua ibaresinin ciltlerdeki kullanım amacını ve kullanıldığı dönemleri belirlemeye çalışmaktır. Cilt sanatı literatürü ve yazma eser kütüphanelerinde yaptığımız araştırmalar neticesinde, Beylikler dönemine ait ciltlerin altı tanesinin kapak içinde el-İzzü’d-Dâim ve’l-İkbâl ibaresi tespit edilmiştir. Bu tespitlerin sayısı, yapılacak yeni araştırmalarla artabilecektir. Tespit edilen yazma eserler; Amasya YEK: 217, İnebey YEK Hüseyin Çelebi: 481 ve Ulu Cami: 318, Kastamonu YEK: 2856 ve 3435 ve Süleymaniye YEK Fatih: 5004’tür. Ciltlerin kapak, sertâb ve mikleb yüzeylerindeki tezyînatları, Beylikler dönemi cilt sanatı üslûbunu yansıtan süslemelerdir. Ciltlerin teknik ve tezyînatları, -mevcut olanların- istinsâh kayıtları incelendiğinde üç örneğin (Amasya YEK: 217, Kastamonu YEK: 2856 ve 3435) 14. yüzyıl tarihli olduğu ya da tarihlendirildiği, üç örneğin (İnebey YEK Hüseyin Çelebi: 481 ve Ulu Cami: 318, Süleymaniye YEK Fatih: 5004) ise 15. yüzyıl tarihli olduğu ya da tarihlendirildiği görülmektedir. Ciltlerin kapak içi deseni, bitkisel ve rûmî motiflerle bezeli tam zemin geometrik bir tasarıma sahiptir. Geometrik desenin içerisindeki altıgen paftalarda el-İzzü’d-Dâim ve’l-İkbâl (العزّ الدّائم والإقبال) yazısı yer almaktadır. İbarenin, cilt kapak içlerine tek satırda (İnebey YEK Ulu Cami: 318, Kastamonu YEK: 3435) ve çift satırda -½ oranında ters simetrik- (Amasya YEK: 217, İnebey YEK Hüseyin Çelebi: 481, Kastamonu YEK: 2856, Süleymaniye YEK Fatih: 5004) olmak üzere iki türde yazıldığı tespit edilmiştir. Her iki tasarımda da sülüs yazı çeşidi tercih edilmiştir. İnebey YEK Hüseyin Çelebi: 481 envanter numaralı 15. yüzyıla ait cildin kapak içinde ise diğer örneklerden farklı olarak yazı paftalarının bazılarında mücellit kitabesi bulunmaktadır. Kitabede, “Amel-i Mücellid Haydar b. Turbegî” yazılıdır. Kapak içi tezyînatının aynı olması nedeniyle, Kastamonu YEK: 2856 ve Süleymaniye YEK Fatih: 5004 envanter numaralı ciltlerin de Haydar b. Turbegî adlı mücellidin eseri olma ihtimali vardır. Ciltlerin kapak içlerinin tümü, çeşitli tonlarda kahverengi sahtiyanla kaplıdır. Derilerin gözenek türü bunu ispat eder niteliktedir. Süsleme tekniği, tüm kapak içlerinde soğuk baskı tekniğidir. Bu teknik adını, uygulanması esnasında altının kullanılmamasından almaktadır. Soğuk baskı tekniğinde, desenin deriye genellikle sıcak pres uygulaması yapılarak aktarıldığı bilinmektedir. Uygulamada yüzeyinde motif veya desenin yer aldığı kalıp, çivi ve diğer ciltçilik aletleri kullanılmaktadır. Çalışma kapsamındaki ciltlerde kapak içi deseninin kalıpla uygulandığı, deri üzerindeki desenin kesintili çizgilerden anlaşılmaktadır. Kapak içi tezyînâtını oluşturan desenin simetrik bir parçası, kalıba işlenmiş ve kalıp deri üzerine simetrik bir şekilde, boşluk bırakılmadan basılmıştır. Yapılan incelemelerden anlaşıldığı kadarıyla kalıbın basıldığı deri, kapak içine yapıştırıldıktan sonra kapak kenarlarından cilt ebadına uygun şekilde kesilmiş olmalıdır. Kalıbın bazı örneklerde hatalı basıldığı da görülmektedir. Bu da desenin devamlılığını kısmen bozmuştur. Soğuk baskı tekniğinde, desenin deriye genellikle sıcak pres uygulaması yapılarak aktarıldığı bilinmektedir. Desenin deri renginden daha açık olması, uygulamanın ısıyla yapılmış olduğunu doğrulamaktadır. Ciltlerin kapak yüzeylerinin kullanıma bağlı olarak yıprandığı ve bu nedenle desenlerin deforme olduğu tespit edilmiştir. Ancak kapak içleri böyle bir yıpranmaya maruz kalmadıkları için korunarak günümüze ulaşmıştır. el-İzzü’d-Dâim ve’l-İkbâl (العزّ الدّائم والإقبال) ibaresi Arapça bir terkip olup “sonsuz güç ve yüksek mevki” anlamına gelmektedir. Terkip; güç, kudret ve ihtişam anlamına gelen العزّ ve ferah, parlak ve yüksek mevki anlamındaki الإقبال kelimelerinden oluşmaktadır. İbare dua, temenni vb. maksatlarla kullanılmış olmalıdır. Çalışma kapsamındaki ciltler ve diğer İslam sanatı örneklerinden anlaşıldığı kadarıyla İslam sanat eserleri üzerinde el-İzzü’d-Dâim ve’l-İkbâl ibaresine 12. yüzyıldan 15. yüzyıla kadar geniş bir dönemde yer verilmiştir. Arapçada kelimelerin bir araya gelişi belli bir düzen içerisinde gerçekleşir. Çoğunlukla terkîb olarak adlandırılan bu kombinasyonda öğeler arası anlam ilişkileri genellikle basittir. İzâfet terkîbi olarak adlandırılan isim tamlamasında ise kompleks ama bir o kadar da zengin anlam ilişkisi mevcuttur. Meselenin i‛râb eksenli değerlendirildiği geleneksel nahiv anlayışında öğeler arasındaki anlam ilişkisine dair nüve niteliğinde değerlendirmeler mevcutsa da daha çok ta‘rîf-tahsîs ve âmil-ma‘mûl ilişkileri öne çıkarılmaktadır. Konuyu arzu edilen düzeyde ele alan modern çalışmaların sayısı son derece az olup bunlar geliştirilmeye müsaittir. Meseleye (...) katkı sunmayı amaçlayan bu çalışmada konuyla ilgili geleneksel bakış açısı betimleyici bir yaklaşımla ortaya konmuş ve Arap yazılı kültüründeki isim tamlaması örnekleri tümevarım yöntemi ile incelenerek tamlamanın öğeleri arasındaki ilişkilere dair tespitlerde bulunulmuştur. On beş ilişkinin irdelendiği bu çalışma Arapçada isim tamlamalarının belli formel kalıpların ötesinde zengin bir anlam dünyasını barındırdığı ve dildeki iletişim işlevinin daha sağlam bir zeminde gerçekleşmesi adına bu ilişki ağının çözümlenmesinin önemli olduğu sonucuna ulaşmıştır. Allah’ın ilk insanı, ilk peygamber yapmak suretiyle, insanoğlu ile iletişim kurmayı ve ona hitap eden vahiyler göndermeyi amaçladığı anlaşılmaktadır. Söz gelimi Tevrât’ı İbranice, İncîl’i Süryanice ve Kur’ân’ı Arapça göndermek suretiyle insanlar tarafından anlaşılmak istemiştir. Bununla birlikte onun İbranice kelâmı, Süryanice sözünden ve Arapça kelâmı da diğer dillerdeki sözünden farklı bir tabiata sahiptir. Bu gerçeklikten hareketle İslâm düşünce-fikir tarihine bakıldığında ilim adamlarının ilâhî kelâmın mâhiyetini, tabiatını anlamak ve bunu anlamlandırmak konusunda bir çabanın içerisine girdikleri görülmektedir. Esasen Allah’ın nasıl bir kelâma sahip (...) olduğunu anlamak ve kavramak, cismanî/fizik âleminden gayrı cismanî/fizikötesine doğru bir bakış çabasıdır. Buna rağmen hakikatin yılmaz arayıcısı insan, bu konuda söyleyecek bir söz bulabilme çabası içindedir. “İlâhî kelâmı”, Allah’ın bir sıfatı olarak değerlendirenler olduğu gibi bunu “ilâhî bir fiil” olarak telakki edenler de bulunmaktadır. İlâhî kelâm sıfatının veya fiilinin tecellîsinin Kur’ân olduğu da ehlince müsellemdir. Kur’ân lafızlarının aidiyeti konusunda başlıca üç görüş ortaya konulmuştur. Bu görüşler içerisinde hâkim ve râcih bakış açısına göre Kur’ân metni, lafız ve mana itibariyle Allah’a aittir. Buna göre Hz. Muhammed’e nâzil olan Kur’ân vahyi hem lafız hem de manadan oluşmaktadır. Bu telakkîyi savunan müelliflere göre vahyin oluşumu ve iletimi konusunda ne Cebrâil’in ne de Hz. Muhammed’in herhangi bir müdahale veya katkısı olmuştur. Dolayısıyla peygamberin vahiy nüzûl sürecinde rolünün tamamen pasif olduğu söylenebilir. Cibrîl, Kur’ân’ı önceden yazılı olarak bulunan bir mekândan, yani levh-i mahfûzdan ezberleyerek veya Allah’tan işiterek ya da Allah’ın lafızları ona vahyetmesiyle Hz. Peygamber’e indirmiştir. İkinci yaklaşıma göre Kur’ân metninin manası Allah’a, lafızları Hz. Peygamber’e aittir. Bu yaklaşıma göre Cebrâil, sadece manaları Hz. Peygamber’e indirmiştir. Hz. Peygamber de kendisine bildirilen manaları kavramış ve onları Arapça ifade kalıplarında söylemiştir. Üçüncü yaklaşıma göre ise Kur’ân’ın manası Allah’a, lafızları Cebrâil’e ait olmaktadır. Yani Cebrâil’e yalnız mana ilkâ edildi ve o lafızları oluşturdu. Bu çalışmada İslâm düşünce tarihinde ilim adamlarının kelâmullâhın tabiatını anlamak ve bunu anlamlandırmak konusunda lafızların aidiyeti konusunda ortaya koydukları söz konusu yaklaşımlar öncelikle deskriptif (tasvîrî/betimleyici) bir üslupla incelenmektedir. Akabinde bu doğrultuda serdedilen yaklaşımlar Kur’ân’ın bütünlüğü ve klasik dönem tefsir merviyyâtı açısından analitik (tahlîlî/istidlâlî) bir bakış açısıyla irdelenmektedir. Denilebilir ki Kur’ân’ın mana yönüyle Allah’a aidiyeti konusunda ilim ehli arasında herhangi bir ihtilâf yoktur. Temel ihtilâf Kur’ân lafızlarının Allah’a mı Cebrâil’e mi yoksa Hz. Muhammed’e mi ait olduğu hususudur. Kur’ân’ın bütünlüğü ve vahyin nüzûl keyfiyetine dair klasik dönem tefsir rivayetleri dikkate alındığında hâkim görüşün diğer iki görüşe göre daha tutarlı olduğu kanaatine ulaşılmaktadır. (shrink)

Bu çalışmada klasik eserlerden modern çalışmalara kadar birçok dilsel araştırmaya konu olan dilsel örüntünün son dönem dil çalışmalarına yansıması olan tedâmm olgusunun Arap dilinde cümlenin anlamsal bütünlüğüne katkısı ele alınmıştır. Bu olgu aslı itibariyle tüm dillerde farklı şekillerde bulunan temel örüntünün nasıllığını gözler önüne seren, şekilsel bir olgudur. Dilde iki unsurun birbirini gerektirmesi (istilzâm) veya kesinlikle yan yana gelmemesi (tenâfî) gibi durumlar tedâmm olgusu bağlamında incelenir. Her fiilin bir fâilinin (merfu bir isminin) olması, ism-i mevsûlün bir sıla cümlesine ihtiyaç duyması, (...) sıfat ile mevsuf, mudâf ile mudâfun ileyh birliktelikleri istilzâm kapsamında değerlendirilirken; mudâf olan kelimenin fiil, zamir veya şart edatı olmaması tenâfî bağlantısı bağlamında ele alınır. İstilzâm ve tenâfî bağlantıları tedâmm olgusunun temel taşlarını oluştururken art arda gelen kelimelerin cümlenin söz diziminde belirli konuma sahip olmalarını gerekli kılan tevârud /tertipsel bağlantı da tedâmm olgusunun ayrılmaz bir bileşenidir. Bu konum göz önüne alınmayıp ihlal edildiğinde, cümlede meydana gelen anlamsal boşluklar sebebiyle cümle, öğrenilmiş dil kalıplarının dışına çıkar. Bu yönüyle cümleyi oluşturan kelimeler arasındaki doğal dizemsel bağlantı ya da cümle içerisinde kelimenin, kendisine eşlik eden diğer kelimelerle uyumlu birlikteliği de tedâmm olgusunun kapsamına girmektedir. Ayrıca bazı dilbilimciler, tertipsel bağlantıyı makam kavramıyla da ilişkilendirerek tedâmm olgusunu nahvî uyumun ötesinde belâğî bir üslup bağlamında değerlendirilmeye müsait hale getirmişlerdir. Bu açıdan bakıldığında tedâmm olgusuna çağdaş dilciler context of situation/ durumun bağlamı olarak nitelenen bir yön kazandırmıştır ki bu yönüyle tedâmm olgusu cümleye, nahvî örüntüden daha fazla anlamsal katkı sağlamaktadır. Bu çalışma, dildeki doğal örüntüye dikkat çekerek tedâmm olgusunun anlaşılmasıyla zihinde netleşen hazif, zikir, istitâr, rütbe ve takdir gibi olguların daha net anlaşılmasına katkı sağlaması açısından önemlidir. Çalışma, tedâmm olgusunun cümlenin anlamsal bütünlüğüne katkısını ortaya koymaya çalışan nitel bir araştırma olup, çalışmada veri toplama araçlarından belge inceleme aracı kullanılmıştır. Veri çözümleme aşamasında ise doküman analizi ve betimsel analiz teknikleri kullanılmıştır. Çalışma neticesinde, tedâmm olgusunun, alt unsurlarıyla birlikte cümlede anlamsal bütünlüğü sağladığı, bu bağlantıya dikkat edilerek oluşturulan cümlelerin anlamsal açıdan daha uyumlu bir bütünlük oluşturduğu görülmektedir. Cümledeki bu uyumu sağlayan tedâmm bağlantısının, alışılagelmiş ve genel kabul görmüş cümle örüntülerinin gramatik kurallara uygun bir şekilde kullanımını içerdiği sonucuna ulaşılmaktadır. Ayrıca bu bağlantı, konuşulan ortamın gereğine uygun söylenmiş lafızların içinde bulunulan makama uygun olarak yorumlanmasını da kapsamaktadır. (shrink)

Toplumsal cinsiyet, erkek ve kadının toplumsal yönden belirlenmiş olan rol ve sorumluluklarını ifade etmek üzere ortaya çıkmış bir kavramdır. Cinsiyetsizleştirme veya cinsiyetsizlik kavramı ise doğuştan gelen ve yaratılış gereği sahip olunan cinsiyet kalıplarının gereksizliğine vurgu yapan, cinsiyet üzerinden oluşan toplumsal kabullerden sıyrılmayı hedefleyen bir zihniyetin dışa vurumudur. Her iki düşünce yapısında eleştirdiğimiz husus ise ataerkil toplum yapısının adaletsiz ve ayrımcı olduğuna dikkat çekilmek istenirken biyolojik cinsiyet özelliklerinin yok sayılmak istenmesidir. Cinsiyet seçiminin bireylerin kendilerine bırakılması fikrine kadar uzanan bu özgürlük anlayışı, (...) insan fıtratının ve toplumsal değerlerin tahrip edilmesine neden olmaktadır. Oysa İslam dini fıtratı bozmaya yönelik her türlü müdahaleyi şer‘î ve hukukî açıdan sakıncalı görerek yasaklamıştır. Bu yönüyle cinsiyetsizleştirme projeleri İslam’ın dayandığı temel esaslara aykırıdır. Bu çalışma ile cinsiyet temelli güncel tartışmaların dayanak noktalarının tespiti sağlanmıştır. Çalışmanın amacı, İslam hukukunun cinsiyetler arasında ayrımcı ve imtiyazcı bir tavrı benimsemediğini ortaya çıkarmaktır. Zira İslam'ın temel kaynaklarında toplumsal cinsiyet rollerine ilişkin dengeleyici bir politika izlenmektedir. Cinsiyet savunucularının düşüncelerinin aksine, cinsiyet ayrımının temeli dinî kaynaklardan değil ataerkil düşünce yapısından kaynaklanmaktadır. Bir diğer amaç ise cinsiyetler arası eşitlikten ziyade cinsiyet rolleri üzerinde sağlanacak adaletin toplum değerleri açısından dengeleyici bir yaklaşım olacağının altını çizmektir. Toplumsal düzen arayışında adil, dengeleyici ve bütünleştirici bir tutum benimsemek cinsiyetler arasında ortaya çıkan sorunların aşılması noktasında tutarlı bir yaklaşım oluşturacaktır. Çalışmamız, nitel bir yaklaşımla literatür tarama yöntemi ve veri analizi tekniği ile gerçekleştirilmiştir. Bu çerçevede toplumsal cinsiyet ve cinsiyetsizlik söylemlerinin neslin korunması adına oluşturabileceği problemler ele alınmıştır. Bu çalışma, cinsiyetsiz toplum söyleminin, bireylerin kişilik haklarına yönelik bir müdahale olduğu görüşünü ortaya koymaktadır. Ayrıca bu tür söylemlerin, toplumun temelini oluşturan aile değerlerini tehdit ettiği ve dolayısıyla toplumsal yapıyı bozduğu yönündeki endişelere dikkat çekmektedir. Çalışmayı önemli kılan bir diğer husus, cinsiyetler üzerinden kullanılan çatışmacı dilin, kadın ve erkeği birbirleriyle rekabet etmeye yönlendirerek karşı karşıya getirdiğini vurgulamasıdır. Toplumsal konuların erkek ve kadın değil, insan hakları perspektifinden ele alınması, insanların dillerine, dinlerine, renklerine, mesleklerine veya cinsiyetlerine göre değerlendirilmemesi gerektiği yönüne dikkat çekilmiştir. In lieu of an abstract, here is a brief excerpt of the content:Tacitus, Germanicus, Piso, and the Tabula SiarensisJulián GonzálezTacitus describes the funerary honors that were decreed for Germanicus in a dense narrative covering the whole of chapter 83 of book 2 of his Annals. Modern critics consider that this extensive chapter was taken from the acta senatus, from which not only the senatus consulta would have been taken but also various items from the debate, especially the sententiae of the (...) senators and the interventions of the emperor himself. 1 In the introductory phrase honores ut quis amore in Germanicum aut ingenio ualidus reperti decretique the word decreti clearly indicates that we are dealing with a decision of the Senate, but I also believe that reperti, “found after a search,” ties in perfectly with the result of a senatorial deliberation. This initial supposition is supported by Ann. 2.83.3, where Tacitus records the proposal of the Senate to dedicate to Germanicus a golden imago clipeata among the portraits of the classical orators (cum censeretur clipeus auro et magnitudine insignis inter auctores), a proposal rejected by Tiberius. The use of the technical term censeretur, “vote,” and the fact that Tacitus records the intervention of the emperor verbatim can only be explained in terms of direct consultation of the acta senatus.The Tabula Siarensis, discovered in 1982 in the province of Sevilla, preserves on two large bronze fragments much of the Senatus Consultum de Honoribus Germanici Decernendis that was decreed at the end of A.D. 19. We know this from fr. IIb, lines 20–21, in which it is decreed that the senatus consultum be inscribed together with another, earlier, senatus consultum, which was passed on 16 December (Itemque hoc s(enatus) c(onsultum) in aere incideretur cum eo s(enatus) c(onsulto) quod factum est A.D. XVII kal. Ian.... figeretur). The text of fr. IIb, lines 18–19, placere uti libellus, quem is (Drusus) proxumo senatu recitasset, in aere incideretur, mentions, in turn, another session of the Senate different from that of 16 December. [End Page 123]As we compare Tacitus’ narrative with the official documents, then, we have to reckon with two (or three) senatus consulta and one comitial law, the lex Valeria Aurelia (found on the Tabula Hebana), through which we have at our disposal an unrivaled wealth of information on the funerary honors of Germanicus. This will allow us to ascertain not only to what extent Tacitus uses the acta senatus and in what way he adapts his narrative to the content of these sources, but also to what extent his signature statement sine ira et studio is valid. Thanks to these discoveries, we now have another example to add to the speech of Claudius in support of the admission to the Senate of the leading men of the Three Gauls. Although it is certain that Tacitus used the acta senatus, our first observation in comparing his narrative to the contents of the Tabula Siarensis and the Tabula Hebana is in some ways surprising, since Tacitus only mentions a dozen honors, while the Tabula Siarensis records a total of twenty-seven, to which one must add others to be found in the Tabula Hebana that are equally ignored by Tacitus.Tacitus divides Germanicus’ funerary honors into four sections:1. In the first of these he mentions the following: (a) that his name be sung in the carmen Saliare; (b) that the curule chairs, decorated with laurel crowns, be positioned in the places usually occupied by the sacerdotes Augustales; (c) that an ivory statue of him precede the pompa circensis; and (d) that no flamen or augur be elected in his place unless he belong to the gens Iulia. These measures do not feature in the extant portions of the Tabula Siarensis, although the Tabula Hebana mentions some of them, specifically the inclusion of Germanicus’ name in the carmen Saliare (Tab. Heb. lines 4–5), and the positioning of the curule chairs, decorated with laurel crowns, in places usually occupied by the sodales Augustales (Tab.
